Fake IDs in Texas
A Growing Problem
Like states across the nation, Texas is trying to meet the challenge of more fraudulent IDs whether presented in person or by digital image. Many of these fake IDs come from counterfeiters located overseas with sophisticated equipment. As stories below illustrate, fake identification is getting easier to obtain in the Lone Star State and is often associated with illegal alcohol purchases by minors and financial fraud.
Alcohol Sales & Service Guidelines for Texas
- Minimum age to consume: 21 with some exceptions
- Minimum age to serve: 18
- Minimum age to bartend: 18
A person under 21 may purchase alcoholic beverages as part of a law enforcement action.
Penalties for serving or selling to a minor: In Texas, selling alcohol to a minor is a Class A misdemeanor that can result in a fine of up to $4,000, up to one year in jail, or both. The seller's driver's license will also be automatically suspended for 180 days.
Additionally, adults who knowingly provide alcohol to a minor or allow them to be served on their property may be held liable for any damages caused by the minor's intoxication.
There are some exceptions to these penalties, including:
- If the adult is the minor's parent, guardian, spouse, or someone who has been given custody of the minor by a court, and they are present when the minor consumes the alcohol
- If the alcohol is being provided in certain specific circumstances, such as in a college culinary course
These laws apply to any location that sells alcohol, including convenience stores, liquor stores, bars, pubs, hotels, and grocery stores. Employees at these establishments are required to check the ID of anyone who looks too young to legally purchase alcohol.
